Sailing Terms and Conditions of Business
Cancellations
Payments will
be refunded if:
In the event of a student cancelling a course 28 days or more prior to
the commencement of the course, every effort will be made to resell the
course. If the course is resold, the student will be liable for 10% of
the course fee by way of a handling charge. If the course is not resold,
the student shall be liable for 25% of the course fee, (i.e. the deposit)
If the student cancels a course between 14 and 28 days before the commencement
of the course, the student shall be liable for 50% of the course fee.
Should the student cancel a course less than 14 days before the commencement
of the course, then the full course fee shall be payable.
It should be noted that in exceptional circumstances, (bereavement etc),
the full course fee may be refundable in all cases. The decision rests
with the Principal or his appointed deputy.
Course Duration
Weekend courses run from approximately 1900 hrs Friday until approximately
1600 hrs the following Sunday.
5 day courses run from approximately 1900 hrs Sunday until 1600 hrs the
following Friday.
7 day courses run from approximately 1900 hrs Sunday until 1800 hours
the following Sunday.
Theory courses will run from 0900 hrs to 1700 hrs approximately each day
for the duration of the course. The foregoing times are of course dependent
upon the weather conditions and the Instructor's decisions and the seaworthiness
of the vessel at the time.
Accommodation
Is provided on board the yacht for practical courses. We reserve the
right to have up to a maximum of five (5) students per boat.
Age
Limits
We cannot
accept students under the age of 16 unless accompanied by a parent/guardian.
Students between 16-18 years of age will require written authority of
a parent/guardian.
There is no upper age limit, but it will be the student's responsibility
to satisfy themselves that they are fit and able to join their chosen
course.
Late
Arrivals
We will make every effort to revise sailing timetables to accommodate
late arrivals. However, if such delays inconvenience other students, the
skipper may decide to sail without the delayed student. In such cases,
no refunds will be given.
Health
Sailing is an activity sport and it is the responsibility of the students
to ensure that they are fit and healthy to sail. Please check with your
doctor if you are in any doubt. If for whatever reason the skipper has
put a student ashore or administered medical aid, no liabilities are accepted
by Meridian Sailing or the skipper.
Insurance
The school is insured for instruction, the School's vessels, equipment
and buildings. · However, this does not cover the student's personal possessions,
motor cars, negligence/injury or disablement however caused. Students
are strongly recommended to take out personal/cancellation insurance.
RYA
Certificates
Our standards of instruction are high and certificates will not be issued
automatically. If, in the instructor's opinion, the student has not reached
the necessary standard, the student may be asked to resit any examination.
Coastal Skipper and Yachtmaster Offshore practical exam passes are at
the discretion of the RYA examiner. Appeal may be made to the RYA in the
event of failure to pass any examination.
Student
Responsibilities
All students will be expected to participate in cooking, cleaning the
vessel and routine maintenance as required by the Instructor.
At the end of the course, the students are expected to clean the vessel
to an as found condition.
Any equipment borrowed from the school for the duration of the course
must be returned at the end of the course.
The cost of replacement will be levied in the event of the non-return
of equipment.
Force
Majuere
In the event of non-performance, partial performance or delay resulting
wholly or partly from any force majuere or occurrence or circumstance
whatever beyond our control including the acts or omissions of third parties,
labour difficulties, weather conditions, technical breakdown or accident
to any vessel or any part of it, natural disaster or the act of any authority,
then we shall use reasonable endeavours to continue or perform the booking
but otherwise shall have no liability to the student. The student shall
be liable to pay such a part of the price as is applicable to that part
of the booking which has been performed (if any), and all expenses connected
with it. Anything in excess paid by the student shall be refunded.Our
determination of the applicable part of the price and the connected expenses
shall be conclusive in the absence of manifest error.
